How does OPSSC monitor?

Under section 97 of the Public Sector Management Act 1994 and the Public Sector Management (Breaches of Public Sector Standards) Regulations 2005, OPSSC reviews breach of standards claims. It is our job to determine whether a standard has been breached.

The Public Sector Management (Breaches of Public Sector Standards) Regulations 2005 (external website) came into effect on 1 September 2005. They provide a legislative base for the handling of a breach of standard claim. The regulations:

  • enable people to make a compliance inquiry (breach of standards claim) if they believe a standard has been breached, and they have been adversely affected by the breach;
  • provide for impartial handling of the claim, resolution where possible and, where resolution does not occur, an independent determination by the Commissioner on whether there has been a breach of the standard; and
  • provide for the Commissioner to recommend action to an agency to correct a breach when a breach is found.

Agencies covered by the breach of standards regulations

All Western Australian public sector agencies are covered by the regulations governing breach of standards claims, except for those agencies named in Schedule 1 of the Public Sector Management Act 1994 (external website). These organisations are not covered by the standards. You cannot make a breach of standards claim about their processes.
